Justice After 50 Years: John Clarke Leads Landmark Victory for George Williams.
In a landmark judgment delivered on 26 June 2025, the Supreme Court of Jamaica awarded damages to George Williams, a mentally ill individual who had been detained for fifty years without trial. The court found that Mr Williams’ constitutional rights, including the right to due process, a fair hearing, and protection from inhuman and degrading treatment, were breached. Mr John Clarke, Attorney‑at‑Law and lead counsel in the matter, successfully contended that the State failed in its duty to conduct periodic assessments of Mr Williams’ mental fitness and to ensure a timely trial. The judgment not only provides long overdue redress but also sets important legal precedent regarding the treatment of mentally ill detainees within Jamaica’s criminal justice system.
Terrence Williams KC successfully defends BVI civil servant in diplomatic immunity case.
In a judgment delivered on 23 June 2025 by the High Court of the Virgin Islands, Terrence Williams KC successfully argued a plea of diplomatic immunity on behalf of a senior public officer. The court held that the defendant, acting in the course of her official duties and under the authority of her diplomatic accreditation, was immune from the civil proceedings instituted against her. The judgment reaffirmed the applicability of the Vienna Convention on Diplomatic Relations within the jurisdiction and elucidated the scope of immunity afforded to state officials engaged in acts of government. Mr Williams submitted that the actions impugned including the issuance of a diplomatic note were carried out pursuant to lawful authority and fell squarely within the remit of the defendant’s official functions. The court accepted these submissions and affirmed the continuing relevance of sovereign immunity and the supremacy of international legal obligations within domestic proceedings.

The charge concerned the building of a perimeter wall for the Elmore Stoutt High School in Tortola, BVI.
